In accordance with the State of Illinois Freedom of Information Act (FOIA) (Chapter 5 ILCS 140), access to and copies of certain Department records are made available to the public upon receipt of a request. FOIA Requests, by law, are to be processed within five (5) business days (twenty-one (21) business days for commercial purpose records requests). Requestors will be notified when their request has been processed, and if we are able to honor your request, the date and time which you may pick up or examine the requested record(s).
In some circumstances, it may take longer than normal to process certain record requests, and in accordance with Chapter 5 ILCS 140, Section 3 (e), the Department may extend the time period to process the request by an additional five (5) business days. The requestor will be notified when the Department determines the need to extend the time period to process the request, and the specific reason for such extension.
In some circumstances, certain information in a record may be redacted, or, access to or a copy of an entire record may be denied, in accordance with Chapter 5 ILCS 140 Section 7-1. The requestor will be notified when the Department chooses to redact certain information, or deny access to or a copy of certain records, and the reason for such redaction or denial.
Per Chapter 5 ILCS 140 Section 9.5 (a), you may request a review of a FOIA denial by the Department to the Public Access Counselor within sixty (60) days of the denial.
